1. Scope and provider

1.1 These terms of use apply to this website, which is operated by Maven Labs UG (haftungsbeschränkt), Baaderstraße 17, 80469 München, Germany (“Maven Labs”, “we”). Full provider details are in the Imprint.

1.2 They apply to everyone who visits the website, whether as a consumer (§ 13 of the German Civil Code, BGB) or as an entrepreneur (§ 14 BGB).

1.3 They do not govern MavenOS or any other paid service. Those are provided only under a separate agreement with the customer, which takes precedence over these terms.

2. What the website offers

2.1 The website provides information about Maven Labs and MavenOS, a journal, and a form for requesting a demo. Using the website is free of charge.

2.2 Content on the website is general information. It is not a binding offer, and it is not legal, tax, financial or other professional advice.

2.3 Product views, figures and examples are illustrations. They do not describe an agreed quality and are not a guarantee. What we owe a customer follows only from the contract with that customer.

2.4 We may change, extend, restrict or discontinue the website or parts of it at any time. There is no entitlement to uninterrupted availability.

3. Demo requests

3.1 Sending a demo request does not create a contract and does not oblige either side to enter into one.

3.2 Please give accurate details, and only your own or those you are authorised to share. How we handle them is set out in the Privacy policy.

4. Permitted use

4.1 You may view the website and download or print individual pages for your own information.

4.2 You must not:

• (a)use the website in a way that breaks applicable law or infringes the rights of others;
• (b)interfere with its operation or security, for example by introducing malware, by overloading it or by probing it for vulnerabilities without our permission;
• (c)try to gain access to areas or data that are not meant for you;
• (d)copy or extract substantial parts of the website systematically or by automated means, apart from ordinary indexing by search engines;
• (e)present our content as your own, or remove copyright or other proprietary notices.

4.3 We reserve the use of the content of this website for text and data mining within the meaning of § 44b of the German Copyright Act (UrhG).

5. Intellectual property

5.1 All content on the website, including text, images, graphics, film, software and layout, is protected by copyright and other rights and belongs to us or to our licensors.

5.2 “Maven Labs”, “MavenOS” and our logos identify our business and may not be used without our prior consent. Names and logos of other companies shown on the website belong to their owners.

5.3 Any use beyond clause 4.1 requires our prior consent in text form. Statutory permissions, such as the right to quote, remain unaffected.

6. Links to other websites

6.1 The website contains links to websites operated by third parties. We have no influence over their content; the operator of the linked website is responsible for it.

6.2 We checked linked pages when we set the link. If we learn that a linked page infringes the law, we will remove the link without delay.

7. Liability

7.1 We are liable without limitation:

• (a)for intent and gross negligence;
• (b)for injury to life, body or health;
• (c)under the German Product Liability Act (Produkthaftungsgesetz);
• (d)where we have fraudulently concealed a defect or have given a guarantee.

7.2 In cases of slight negligence we are liable only for breach of a material obligation, that is, an obligation whose fulfilment makes the proper use of the website possible in the first place and on which you may regularly rely. In that case our liability is limited to the damage that is foreseeable and typical for this kind of use.

7.3 Beyond that, our liability is excluded. This also applies to the personal liability of our legal representatives, employees and agents.

7.4 We prepare the information on the website with care, but we do not warrant that it is complete, correct and up to date at all times. Clause 7.1 remains unaffected.

8. Data protection

8.1 How we process personal data when you use the website is described in the Privacy policy and the Cookie policy.

9. Changes to these terms

9.1 We may amend these terms with effect for the future, for example when the website or the law changes. The version published here at the time of your visit applies.

10. Governing law and jurisdiction

10.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.

10.2 If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the use of the website is Munich, Germany. Otherwise the statutory rules apply.

10.3 We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

11. Final provisions

11.1 If a provision of these terms is or becomes invalid, the remaining provisions stay in effect. The statutory provisions apply in place of the invalid provision (§ 306 BGB).
